1. Acceptance of Terms

By accessing or using the Bectify platform, website (bectify.com), or any services provided by Bectify, Inc. ("Bectify," "we," "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use our services.

2. Description of Services

Bectify provides an AI-powered automation platform for service businesses. Our services include:

• AI-driven lead capture and qualification via voice, SMS, WhatsApp, Instagram, Messenger, email and webchat
• Automated appointment scheduling and reminders
• CRM integration and contact management
• Nurture sequence automation
• Review management
• Client portal and dashboard
• Website generation and hosting

3. Account Registration

To use our platform, you must:

• Provide accurate and complete business information
• Maintain the security of your account credentials
• Be at least 18 years of age
• Have the authority to bind your business to these terms

You are responsible for all activity that occurs under your account.

4. Subscription & Billing

Bectify services are offered as monthly or annual subscriptions. By subscribing, you agree to:

• Pay the fee for your selected plan and billing period (monthly or annual), charged in advance
• Provide valid payment information
• Accept that fees are non-refundable unless otherwise stated in your service agreement

There are no setup or activation fees. Partial month refunds are not issued.

Free trials. Some plans start with a free trial. The trial length and any usage included are shown when you sign up. Unless you cancel before the trial ends, your subscription starts and your payment method is charged for the plan you chose.

Automatic renewal. Subscriptions renew automatically at the end of each billing period (monthly or annual) and your payment method is charged the then-current fee until you cancel.

How to cancel. You can cancel at any time from the billing page of your Bectify portal, or by emailing support@bectify.com. Cancellation takes effect at the end of the current billing period, and you keep access until then.

We reserve the right to modify pricing with 30 days' written notice.

5. Acceptable Use

You agree not to:

• Use our platform to send spam, unsolicited messages, or messages that violate TCPA, CAN-SPAM, or other applicable regulations
• Misrepresent your identity or the identity of your business
• Use the platform for any illegal purpose
• Attempt to reverse-engineer, decompile, or access the source code of our platform
• Interfere with or disrupt the platform's operation
• Share account credentials with unauthorized parties

6. SMS & Communication Compliance

As a user of our communication features, you are responsible for:

• Obtaining proper consent before sending messages to your customers
• Complying with all applicable telecommunications laws (TCPA, CTIA guidelines, A2P 10DLC requirements)
• Maintaining accurate opt-in records
• Honoring opt-out requests immediately

Bectify provides the tools for compliant messaging, but you are ultimately responsible for how you use them.

7. Data Ownership

• Your data: You retain ownership of all business data, customer information, and content you provide to or generate through our platform
• Our platform: Bectify retains ownership of the platform, software, AI models, workflows, and all intellectual property
• Data portability: You can download your leads and contacts as a CSV file at any time; other data is available on request within 30 days

8. AI-Generated Content

Our platform uses artificial intelligence to generate responses, analyze conversations, and automate workflows on your behalf. You acknowledge that:

• AI-generated responses are sent on behalf of your business, and you are responsible for their content
• AI may occasionally produce inaccurate or unexpected responses
• You should review and adjust AI behavior through the block configuration system
• Bectify is not liable for actions taken by end customers based on AI-generated communications

9. Service Level & Uptime

We strive to maintain high availability but do not guarantee 100% uptime. We are not liable for service interruptions caused by:

• Third-party service outages (Twilio, Retell AI, Supabase, etc.)
• Scheduled maintenance (announced in advance when possible)
• Force majeure events

10. Limitation of Liability

To the maximum extent permitted by law, Bectify shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, lost leads, missed appointments, or data loss arising from your use of our services.

Our total liability shall not exceed the amount you paid to Bectify in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Bectify, its officers, employees, and agents from any claims, damages, or expenses arising from your use of the platform, your violation of these terms, or your violation of any law or regulation.

12. Termination

• By you: You may cancel your subscription at any time, including by contacting support@bectify.com. Cancellation takes effect at the end of the current billing period.
• By us: We may suspend or terminate your account for violation of these terms, non-payment, or at our discretion with 30 days' notice.
• Effect: Upon termination, your access to the platform will cease. Your data is kept until you ask us to delete it; you may request an export of it within 30 days.

13. Governing Law

These terms are governed by the laws of the State of Texas, United States. Any disputes shall be resolved in the courts of El Paso County, Texas.

14. Changes to Terms

We may update these Terms of Service from time to time. Material changes will be communicated via email or platform notification. Continued use of our services after changes constitutes acceptance of the updated terms.
